Civil Actions - Enforcement of Prompt Payment of Claims

Synopsis:

Clarifying that a provision of law requiring payment of interest on claims for reimbursement by health care providers that remain unpaid 30 days after the claim is received by an insurer, nonprofit health service plan, or health maintenance organization may be enforced by filing a civil action; prohibiting a person that files a civil action from filing a complaint arising from the same violation with the Insurance Commissioner; and requiring the award of attorney fees if the action is sustained.
