Eminent Domain - Public Use

Synopsis:

Establishing that private property may not be acquired by condemnation unless it is necessary for public use; defining "public use" to mean the possession, occupation, and enjoyment of land by the general public or a governmental entity, the use of the land for a public service company, or the acquisition of land to cure a concrete harmful effect of its current use; and excluding the public benefits of its current use; and excluding in the definition of "public use" the public benefits of economic development.
