Evidence - Assault Trials - Spousal Privilege - Record of Assertion

Synopsis:

Requiring that the clerk of the court make and maintain a record of the refusal of a spouse of a person on trial for assault, in which the spouse was a victim, to testify; requiring that the clerk of the court make and maintain a separate record of a spouse's refusal to testify when an expungement order is presented; specifying the contents of the separate record; limiting the availability of the separate record; and providing that the separate record is not subject to expungement.
