Authorizing contracts between a health maintenance organization (HMO)
and a subscriber or a group of subscribers to contain provisions
allowing the HMO to be subrogated to a cause of action that a
subscriber has against another person under specified circumstances;
requiring an HMO that includes a subrogation provision in its contract
to use in its rating methodology an adjustment reflecting the
subrogation and identify in its rate filing all amounts recovered
through subrogation; etc.
