Death Penalty - Sentencing - Standard of Proof

Synopsis:

Changing the standard of proof used in weighing aggravating circumstances against mitigating circumstances during the sentencing proceeding of a capital case from the preponderance of evidence standard to beyond a reasonable doubt standard; and providing for the application of the Act.
