Health Care Records - Confidentiality - Ex Parte Communications With Health Care Providers

Synopsis:

Prohibiting a health care provider, subject to specified exceptions, from communicating directly with a person or a person's insurer or legal counsel regarding a patient or a recipient regarding a personal injury claim or family law proceeding; requiring that when a person or a person's insurer or legal counsel requests direct communication with the health care provider, the requesting party provide an affidavit to the provider that attests that the requesting party has notified the patient, person in interest, or patient's legal counsel; etc.
