Nonviolent Drug Offenders - Drug Treatment instead of Incarceration

Synopsis:

Requiring a court to commit a defendant to the Department of Health and Mental Hygiene for drug treatment as a condition of probation instead of incarceration under specified circumstances; requiring a court to discharge a defendant and dismiss the proceedings against the defendant if the defendant successfully completes a drug treatment program under specified circumstances; providing that a discharge or dismissal may not be deemed a conviction for specified purposes; etc.
