Procurement - Public Facility Construction - Liquidated Damages - Reduction Prohibited

Synopsis:

Requiring that each procurement contract for construction of a public facility include a clause that specifies an amount of liquidated damages; prohibiting a court from reducing the amount of liquidated damages unless the court finds that the amount of liquidated damages is so arbitrary and unreasonable as to be a taking of property without due process of law; establishing that the liquidated damages are in addition to other recognized actual damages; and defining a specified term.
