Estates and Trusts - Donation of Conservation Easements

Synopsis:

Clarifying that personal representatives, trustees, and fiduciaries may donate a conservation easement on real property for a specified purpose if the governing instrument authorizes the donation; clarifying that a specified trustee or fiduciary may consent to a donation of a conservation easement on real property by a personal representative for a specified purpose if the governing instrument authorizes the donation; and providing for the retroactive application of the Act.
