Vehicle Laws - Uninsured Motorists - Waiver of Right to Noneconomic Damages

Synopsis:

Establishing that an individual driving a motor vehicle that is not covered by insurance is considered to have waived the right to recover noneconomic loss damages in an action against an insured driver; creating a rebuttable presumption that an individual knows that the motor vehicle is not covered by insurance; prohibiting an individual who waived the right to nonenonomic loss damages from presenting evidence of such losses to the trier of fact; etc.
