Mining Operations - Nuisance Actions
Providing that mining operations, including any change in operations,
that have been under way for a period of 1 year or more and did not
constitute a nuisance from the date the operations began may not be
considered to be a public or private nuisance; prohibiting private
actions against the mining operation from being sustained on the
grounds that the operation interferes or has interfered with the use
or enjoyment of other public or private property; etc.
