Surplus Lines Insurance - Procurement From Unauthorized Insurers

Synopsis:

Clarifying that surplus lines insurance may be procured from an unauthorized insurer only under limited circumstances; requiring the surplus lines broker and the originating agent or broker to execute an affidavit concerning the procurement of surplus lines insurance from an unauthorized insurer; requiring the affidavit to include statements concerning the unavailability of surplus lines insurance from authorized insurers; and applying the Act.
