Synopsis:

Providing that a finder of fact may determine that a person who causes personal injury or wrongful death was acting with malice and award punitive damages if the person was driving or attempting to drive while intoxicated under specified circumstances; providing for specified procedures; and providing for an exclusion of specified coverage.
