Dear Mr. Speaker:
In accordance with Article II, Section 17 of the Maryland Constitution, I have today vetoed House Bill 1117 - Sheriffs' Office Liability - Apportionment of State and County Responsibility.
This bill includes an employee of a sheriff's office within the definition of State personnel for purposes of the Maryland Tort Claims Act (MTCA). The bill also expands the scope of coverage of the MTCA for activities performed by a sheriff, deputy sheriff or an employee of a sheriff's office of a county or Baltimore City to include personnel and administrative actions, activities arising under Maryland State Police multijurisdictional agreements, and any other activities other than law enforcement and detention center functions.
Senate Bill 489, which was passed by the General Assembly and signed by me, accomplishes the same purpose. Therefore, it is not necessary for me to sign House Bill 1117.
